Workers' Compensation for Warehouse Workers Injured on the Job in California

Hollister, CA Warehouse Injury AttorneyWarehouse workers lift heavy loads, operate equipment, and work long shifts. If you are hurt in a warehouse accident in 2026, California law likely gives you the right to workers' compensation benefits.  California's workers' compensation system provides medical care and wage replacement for injured workers without requiring them to prove fault.

A San Benito County, CA workers' compensation attorney can review your situation and explain what you may be owed.

What Are the Most Common Warehouse Injuries in California?

The U.S. Bureau of Labor Statistics reported that warehousing and storage workers had an injury and illness rate of 4.8 cases per 100 full-time workers in 2024. That was higher than the private industry average.

The most common injuries include back and shoulder strains from heavy lifting, forklift accidents, broken bones from falls, and being struck by falling inventory. Many workers also develop repetitive stress injuries over months of doing the same motions. These injuries can be just as serious as a one-time accident, and California workers' compensation covers both types.

What Rights Do California Warehouse Workers Have Under State Law?

California has some of the strongest protections for warehouse workers in the country. In 2021, the state passed Assembly Bill 701, which gives workers at covered warehouse distribution centers several key rights:

  • Employers must disclose work speed quotas to employees in writing.

  • Quotas cannot prevent workers from taking rest breaks or using the bathroom.

  • Quotas cannot require workers to violate health and safety rules.

  • Workers can request a written description of any quota they are expected to meet.

  • Employers cannot retaliate against workers who request quota information or raise safety concerns.

  • Unsafe quota systems may lead to workplace safety enforcement.

If quota pressure caused you to rush or skip a safety step before your injury, that may be relevant to your workers' comp claim.

What Benefits Does California Workers' Comp Provide After a Warehouse Injury?

California workers' compensation covers medical treatment needed for a work injury. Under California Labor Code Section 3600, you do not need to show your employer did anything wrong. You only need to show that the injury happened while you were on the job. Covered care can include:

  • Emergency care and hospital visits

  • Surgery and follow-up appointments

  • Physical therapy and rehabilitation

  • Prescription medication

If your injury keeps you out of work, you may qualify for temporary disability benefits. These pay about two-thirds of your weekly wages while you heal. Workers with lasting harm may qualify for permanent disability benefits if they cannot return to the same type of work.

Once you file a claim, the insurance company has 90 days to accept or deny it under California Labor Code Section 5402. If they do not act within that window, the injury is presumed to be work-related by law. During that 90-day period, the insurer must also authorize up to $10,000 in medical treatment while the claim is under review.

Can a Warehouse Worker in California File a Claim Against Someone Other Than Their Employer?

Workers' compensation is usually the only claim an injured worker can bring against their employer. But warehouse workers are often hurt by people or equipment outside their employer's control.

A forklift with a faulty part from the manufacturer is one example. A vendor or contractor working on-site is another. In those situations, you may be able to file a personal injury lawsuit against that outside party. You can do this in addition to your workers' comp claim.

A third-party lawsuit can recover damages that workers' comp does not cover, such as pain and suffering and the full value of lost wages. Keep in mind that if you receive a third-party settlement, California law requires your employer or its insurer to be reimbursed for workers' comp benefits already paid out.
